Abstract

ABSTRACT This study aims to analyze the decision-making process for criminal offender under the age of 12 from a juridical perspective. In this study the authors used the juridical analysis approach, by conducting a study of laws and regulations, verdicts and other related documents. The result was indicating that the decision making of criminal offender under the age of 12 must be made by considering various factors, such as the severity of the crime committed, age, the mental development level of offender, and other relevant factors. In addition, the decision-making process must be based on the principles of justice and the protection of children's rights. This research also discusses the decision-making procedures for criminal offender under the age of 12 which are regulated in laws and regulations and verdicts. This research has indicated that this decision-making procedure still needs to be improved and giving more attention to the children's rights and ensuring that decisions are taken in accordance with the principles of justice by applying the Article of 82 paragraph (1) in conjunction with Article 76E The Laws of Republic Indonesia Number 17 of 2016 regarding the Determination of Government Regulation in substituting of Laws Number 01 of 2016 regarding the Second Amendment of Laws Number 23 of 2002 regarding Child Protection to become Laws in conjunction with Law Number 11 of 2012 regarding the Juvenile Justice System. In this research can be concluded that the decision making of criminal offender under the age of 12 must be made carefully and must considering various relevant factors and based on the principles of justice and protection of children's rights. The decision-making process must be more improved to ensure that children's rights are protected and the decisions are made in accordance with the principles of justice.
